Le pouvoir de l’empereur byzantin repose sur son choix par Dieu, mais dépend aussi de sa capacité à agir conformément aux lois. Ces deux nécessités assurent respectivement la légitimité et la légalité impériales. Or, si la légitimité exclut quasiment toute intervention humaine, la légalité oblige l’empereur à s’entendre avec l’Église, à écouter ses mises en garde et, parfois, à s’y soumettre. À Byzance, il n’y a donc pas opposition, et encore moins séparation entre l’Église et l’État, qui doivent agir conjointement, tout en veillant à ne pas intervenir dans un domaine réservé par la pratique à l’une ou à l’autre.

The power of the Byzantine Emperor is based on his being chosen by God, but also depends on his ability to act in accordance with the laws. These two necessities respectively guarantee imperial legitimacy and legality. However, if legitimacy almost completely excludes any human intervention, legality requires the emperor to come to an agreement with the Church, to listen to her warnings and, sometimes, to submit to them. In Byzantium, there was therefore no opposition, and still less separation between the Church and the State, which must act jointly, while ensuring there was no encroachment in practice between the two realms.

Несмотря на то, что императорская власть в Византии считалась Богоданной, способность императора действовать в согласии с законом играла не менее значительную роль. Эти два принципа были основой его легитимности и законности. Если с точки зрения легитимности император нес ответственность только перед Богом, то в плане охраны законности он должен был считаться с позицией церкви, выслушивать её внушения и время от времени подчиняться её велениям. В Византии не существовало ситуации противостояния властей и тем более отделения церкви от государства, так как и той и другой вменялось в обязанность действовать совместно, и одновременно не вмешиваться в сферу деятельности каждой из них.
